End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and PTG Media LLC ("Company," "we," "us," or "our") governing your use of the Hello Weather mobile application and any related services (collectively, the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on a device that you own or control
  • Use the App solely for your personal, non-commercial purposes (unless otherwise authorized in writing)

2. Restrictions

You agree NOT to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or attempt to extract source code
  • Sell, sublicense, rent, lease, or distribute the App
  • Use the App for unlawful purposes
  • Circumvent security features or access controls

3. User Accounts

If the App requires account registration:

  • You must provide accurate information
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity under your account
  • We reserve the right to suspend or terminate accounts that violate this Agreement

4. Intellectual Property

The App, including all content, features, functionality, trademarks, and intellectual property rights, is owned by PTG Media LLC or its licensors. This Agreement does not transfer ownership of any intellectual property rights to you.

5. User-Generated Content (If Applicable)

If you submit or upload content to the App:

  • You retain ownership of your content
  • You grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for purposes of operating and improving the App
  • You represent that you have the rights necessary to grant this license
  • We reserve the right to remove content that violates this Agreement

6. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

7. Updates and Modifications

We may provide updates, patches, or improvements to the App. These updates may be automatic or require manual installation. We reserve the right to modify or discontinue the App at any time without liability.

8. Third-Party Services

The App may integrate with or contain links to third-party services. We are not responsible for third-party content, policies, or practices. Your use of third-party services may be governed by separate terms.

9. Termination

This Agreement is effective until terminated. We may terminate or suspend your access immediately if you violate this Agreement. Upon termination:

  • Your license to use the App ceases immediately
  • You must delete all copies of the App from your devices

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

We do not guarantee the App will be error-free or uninterrupted.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall PTG Media LLC be liable for indirect, incidental, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid (if any) to use the App.

12. Indemnification

You agree to indemnify and hold harmless PTG Media LLC from any claims, damages, liabilities, and expenses arising from your use of the App, your violation of this Agreement, or your violation of any law or third-party rights.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the App after changes become effective constitutes acceptance of the revised Agreement.
